4. Counter-Notification

  3. A statement under penalty of perjury that you believe the content was removed by mistake or misidentification.
  4. Your full name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal district court in your area, and that you will accept service of process from the original complainant.

If we receive a valid counter-notice, we may restore the content, unless the original complainant files a court action within 10 business days.

5. Repeat Infringers

HelloGenius reserves the right to terminate access to the Website for any user who is found to be a repeat infringer of copyrighted material.

6. Misrepresentations

Be aware that under the DMCA, anyone who knowingly makes false claims of infringement or misrepresentation in a takedown notice or counter-notification may be subject to liability for damages, court costs, and attorneys’ fees.
